Abandoned Foreign Flagged Vessel Titling

When a foreigner vanishes and leaves a vessel behind, Captain Carr Enterprise works to strip the old title and secure a clean, legal title for the boatyard, dry marina or the marina, a buyer or the local government.
  • Executing Search & Notification: Captain Carr Enterprise performs an international title search to identify all registered owners, lienholders or banks holding a mortgage. Captain Carr Enterprise notifies the foreign owner via international certified mail, publication in local newspapers or through embassy channels to satisfy due process.

  • Navigating Local Abandoned Property Laws: Since maritime law itself does not inherently grant "finders keepers" title, Captain Carr Enterprise utilizes local statutory frameworks (such as local marina abandonment laws or civil codes) to declare the vessel legally abandoned.

  • Managing Flag-State De-Registration: To get a clean title, the vessel usually must be deleted from its original foreign registry. Captain Carr Enterprise submits the abandonment judgement or foreclosure sale paperwork to the foreign registry to secure a Certificate of De-Registration or Evidence of Deletion.

  • Securing New Title/Registration: Once the old title is cleared, Captain Carr Enterprise compiles the chain of custody documents (court orders, bill of sale from a public auction or abandonment certificates) to register the vessel under a new flag or state title.

Abandoned U.S. Flagged Vessel Titling

Boatyard, dry marinas, marinas, yacht clubs and private landowners frequently deal with vessels left behind by their owners. Captain Carr Enterprise manages the bureaucratic process to legally transfer the title to the new owner. 
  • Conducting Title Searches: Captain Carr Enterprise performs comprehensive title searches through state and federal databases including the U.S. Coast Guard National Vessel Documentation Center (NVDC) to identify the last known registered owner and any active lienholders.

  • Executing Statutory Notifications: Captain Carr Enterprise manages the strict legal notification processes required by law. This includes sending certified warning letters to the last known registered owner and publishing public notices in local newspapers.

  • Managing the "Possessory Lien" Auction: Many states allow a boatyard, dry marina or a marina to hold a public auction to recover unpaid dry or wet storage fees. Captain Carr Enterprise organizes the compliance paperwork, ensuring the auction meets all legal criteria to clear the previous owner's rights.

  • Submitting State Abandoned Property Applications: If the auction yields no buyers, Captain Carr Enterprise compiles and submits the state-specific "Abandoned Vessel" application packets to DMV or the environmental agency to issue a brand-new clean title.

  • Clearing USCG Documentation: For federal vessels, Captain Carr Enterprise submits the required state-ordered auction documents or forensic title chains to the USCG to delete the old documentation and document the vessel under the new ownership.

U.S. & Foreign Flagged Maritime Liens

Maritime Lien Process

At Captain Carr Enterprise, we specialize in providing exceptional dry and wet storage maritime lien solutions. Our maritime lien service offers no cost to boatyards or marina provided that Captain Carr Enterprise is notified that a vessel in their boatyard, dry boat storage facility, dry marina or marina is delinquent in their dry or wet storage after 90 consecutive days of non-payment. There is no charge for this service to the boatyard or marina, the vessel owner must pay Captain Carr Enterprise the total amount of the debt, plus pay 20% of the debt amount to terminate the lien process through maritime law. 
  • Captain Carr Enterprise sends out a lien notice to the vessel owner who is in default after 90 days of non-payment for their dry or wet storage fees giving the vessel owner 30 days to pay or forfeit their vessel. In this lien notice contains the total amount of debt owed to the boatyard, dry boat storage facility, dry marina or marina, plus Captain Carr Enterprise's 20% of the total lien amount.

  • The vessel owner must reach out to Captain Carr Enterprise to pay the full amount of the lien notice to Captain Carr Enterprise in order for the lien process to be terminated. If the vessel owner reaches out to Captain Carr Enterprise and states that they cannot pay the delinquent dry or wet storage fees and that they don't want the vessel, then the vessel owner must pay the 20% lien fee (120 days) and sign and notarize a bill of sale transferring the vessel to Captain Carr Enterprise.

  • If the vessel owner chooses not to reach out Captain Carr Enterprise to make payment arrangements. Captain Carr Enterprise will send out one final lien or warning notice to the vessel owner and if after another 30 days the vessel will be deemed abandoned. and will proceed with filing for a title as an abandoned vessel or Captain Carr Enterprise will bring in a maritime attorney to process the maritime lien, and the vessel will be arrested under maritime law in that country where the vessel is being stored.

  • The vessel owner could face severe fines, penalties and or arrest for abandoning their vessel and the debt that is owed to the boatyard, dry boat storage facility, dry marina or marina where the vessel owner signed a rental agreement to store their vessel.

Captain Carr Enterprise maritime lien services process only applies when the vessel has 90 consecutive days of non-payment for the delinquent dry or wet storage fees.
  • The boatyard, dry boat storage facility, dry marina or marina provides a copy of the rental agreement, copy of the vessel documentation and a current invoice showing the total amount of the debt that is owed after 90 consecutive days of non-payment.

  • Captain Carr Enterprise the does an international title search and pulls an Abstract of Title for example from the USCG or wherever the vessel is registered at to make sure the vessel's documentation is current and make sure the owner listed on the documentation matches the name and address on the rental agreement.

  • Then Captain Carr Enterprise sends out a lien notice giving the vessel owner an additional 30 days to pay the total debt (90 days plus the 30 days of the lien notice) and this lien notice lists a lien fee of 20% of the total debt that is to be paid to Captain Carr Enterprise as their processing fee and to terminate the lien process.

  • If the vessel owner pays the full lien notice amount to Captain Carr Enterprise, it is up to the discretion of the boatyard, dry boat storage facility, dry marina or the marina to let the vessel owner off with a warning to not fall behind on their dry or wet storage fees or give the vessel owner 30 days to vacate their vessel from the property.

  • If the vessel owner reached out to Captain Carr Enterprise but cannot pay the 120 days of delinquent dry or wet storage fees, then in order for Captain Carr Enterprise to terminate the lien process, the vessel owner must pay the 20% lien fee amount to Captain Carr Enterprise and sign/notarize a bill of sale or USCG bill of sale transferring their vessel to Captain Carr Enterprise. The vessel will then be listed for sale in order for the boatyard, dry boat storage facility, dry marina or marina to recoup the debt that is owed to them

  • In the event that the vessel owner does not make payment arrangements with Captain Carr Enterpise by or before the 30-day lien notice, then Captain Carr Enterprise will contact a maritime attorney to begin the lien process and file the necessary documents to process the lien against the vessel and arrest the vessel.

  • Once the vessel has been arrested and the lien has been processed then the vessel will go to a lien sale and be auctioned off in order for the boatyard or marina to recoup their debt and in order for Captain Carr Enterprise to receive their 20% lien fee plus the 10% fee for selling the vessel at the lien sale. Captain Carr Enterprise will then transfer the vessel to the new owner.
Captain Carr Enterprise offers efficient and effective dry storage lien solutions against domestic and foreign flagged vessels, ensuring boatyards and dry boat storage facilities recoup their delinquent dry storage fees from the vessel owner directly or through the lien process.
Captain Carr Enterprise offers the same services as their dry storage lien solutions for vessels in marinas or wet storage facilities ensuring the vessel will go to a lien sale or the marina will gain title to the vessel in order to recoup some or all of its delinquent wet storage fees.

Once Captain Carr Enterprise obtains the documentation to abandoned vessels for the boatyard or marina and Captain Carr Enterprise handles all lien and yacht sales for its' clients. At Captain Carr Enterprise, once the lien process is completed then the vessel will go up to public auction and the highest bidder gets the vessel. If the vessel sells for the amount of the debt or less, the boatyard or marina gets 90% from the sale of the vessel and Captain Carr Enterprise gets the remaining 10% from the sale of the vessel.
